Des modifications viennent d’être apportées concernant certaines dispositions intéressants les professionnels du secteur du cinéma et des arts de l’image animée. Que faut-il retenir ?


Cinéma : quelles nouveautés au 28 février 2022 ?

Pour qu’un film puisse être exploité dans les salles de cinéma françaises, son créateur doit obtenir un visa d’exploitation auprès du ministre en charge de la culture.

Ce visa peut alors être refusé ou subordonné à l’application de certaines conditions, comme une limite d’âge.

Certaines modifications viennent d’être apportées concernant les conditions de délivrance de ce visa d’exploitation pour les représentations cinématographiques locales, qui prévoient notamment :

  • soit une durée d’exploitation limitée à 5 ans ;
  • soit un nombre de séances limité et une durée d’exploitation limitée ;
  • soit un nombre de séances limité sans limite de durée.

Notez également que cette demande de visa doit être faite au moins 2 semaines avant la première projection auprès du Centre national du cinéma et de l’image animée (CNC).

En outre il existe une règlementation prévoyant que les cinémas doivent respecter certaines spécifications techniques pour pouvoir être homologués par le CNC. Des cas de dérogations sont désormais prévus en cas d’impossibilités techniques, de disproportion entre les aménagements requis et leurs conséquences, de contraintes liées à la conservation du patrimoine, etc.

Enfin, ces dispositions prévoient également :

  • une notification par voie électronique, dans le cadre de la procédure de conciliation devant le médiateur du cinéma chargé d’intervenir en cas de litige concernant l’accès des œuvres cinématographiques aux salles, les conditions d’exploitations de ces œuvres dans les salles, etc. ;
  • une accélération de la procédure de dérogation au délai d’exploitation des œuvres cinématographiques en vidéo ;
  • des précisions concernant le dispositif de protection de l’accès du public aux œuvres cinématographiques et audiovisuelles.
