Une société décide de signaler son activité de vente de fenêtres en implantant divers drapeaux sur le parking de son magasin. Une enseigne publicitaire, d’après le préfet… mais pas d’après la société. Qui a raison ?


Drapeaux= enseignes publicitaires ?

Soucieuse d’accroître sa clientèle, une société de vente de fenêtres décide de signaler son activité en implantant, sur le parking de son magasin, plusieurs mâts porteurs de drapeaux.

Des enseignes publicitaires, d’après le préfet, dont l’implantation doit, par conséquent, respecter les règles d’urbanisme applicables dans son cas, et notamment les distances obligatoires entre les bâtiments…. Ce que la société n’a pas fait ici.

« Parce qu’il ne s’agit pas d’enseignes », réplique celle-ci : elle rappelle qu’une inscription ne constitue une « enseigne » publicitaire qu’à la condition d’être apposée sur un immeuble, ou située à proximité du local commercial qu’elle indique.

Or ici, les drapeaux sont installés à bonne distance du local commercial : ils ne peuvent donc pas être considérés comme des enseignes publicitaires… et leur implantation n’a pas à respecter les règles d’urbanisme prévues en la matière…

« Faux », rétorque le juge : les drapeaux sont fixés sur des mâts, eux même implantés sur le sol du terrain sur lequel s’exerce l’activité commerciale. Dès lors, ils doivent être considérés comme des enseignes publicitaires, même s’ils sont distants du magasin lui-même.

La société doit donc respecter les règles d’urbanisme propres aux enseignes !
