Un promoteur immobilier achète des terrains sur lesquels il souhaite construire un lotissement, rassuré par l’obtention d’un certificat d’urbanisme (CU) positif. Sauf que la Mairie a commis une erreur : le CU aurait dû être négatif. Mécontent, le promoteur réclame des indemnités à la Mairie…


Certificat d’urbanisme : un document simplement informatif ?

Un promoteur immobilier envisage de créer un lotissement dans une commune. Pour s’assurer de la faisabilité de son projet, il sollicite un certificat d’urbanisme (CU) à la Mairie.

Parce que le CU est positif, il achète les terrains concernés par son projet, sans attendre l’obtention de l’autorisation de lotir, pourtant prévue au contrat de vente, parmi les conditions suspensives.

Mais il est révélé par la suite que la Mairie a commis une erreur : le CU aurait dû être négatif, les terrains n’étant pas constructibles. Mécontent, le promoteur réclame des indemnités à la Mairie, que celle-ci va refuser de verser. Pour elle, le CU est un simple document à caractère informatif ne permettant pas d’assurer que les terrains sont effectivement constructibles.

A tort, pour le juge : le CU n’est pas un « simple » document d’information et a, au contraire, pour objet de fournir l’assurance, ici au promoteur, de la faisabilité d’un projet immobilier. L’erreur de la Mairie a ici causé un préjudice au promoteur qui justifie le versement d’une indemnité.

Toutefois, cette indemnité est limitée à 50 % du préjudice par le juge : ce dernier relève que le promoteur, spécialiste de l’immobilier, a commis une faute en achetant les terrains, situés dans un secteur sensible (protégé par la Loi littoral), sans attendre l’obtention de l’autorisation de lotir.
