Une entreprise a fait appel à un même salarié, en CDD, pendant 9 ans. A l’issue de leur collaboration, le salarié va réclamer la requalification de ses CDD en CDI et prétendre à une ancienneté de 9 ans. Non, rétorque l’employeur qui lui rappelle qu’il ne peut pas remonter si loin…


Requalification du CDD en CDI : comment déterminer l’ancienneté ?

Un salarié réclame la requalification de ses CDD en CDI, avec une ancienneté de 9 ans. Sauf que la prescription l’empêche de remonter si loin, rétorque l’employeur.

Il rappelle, en effet, que toute action portant sur l’exécution du contrat se prescrit par 2 ans… et non par 9 ans ou plus. Par conséquent, il ne peut pas revendiquer une ancienneté de 9 ans.

Sauf qu’en cas de succession de CDD, et bien que la prescription ne soit que de 2 ans, elle ne court qu’à compter du terme du dernier contrat, souligne le juge. Dès lors que le salarié obtient effectivement la requalification de ses CDD en CDI, celle-ci produit ses effets à compter du 1er contrat irrégulier. Il peut donc prétendre à l’ancienneté à partir du 1er CDD irrégulier.
