Une entreprise emploie un salarié dans le cadre d’un CDD. A l’issue de son contrat, le salarié va réclamer la requalification de son CDD en CDI au motif qu’il n’a pas signé le CDD. Sauf que son refus de signer est délibéré, selon l’employeur, ce qui change tout d’après lui….


CDD non signé par mauvaise foi du salarié ≠ CDI

Une entreprise souhaite embaucher un nouveau salarié dans le cadre d’un CDD d’un mois et demi. Elle adresse au candidat retenu un email intitulé « promesse d’embauche », dans lequel elle mentionne son embauche en CDD et en précise la durée.

Mais parce qu’il n’a pas signé de contrat de travail, le salarié réclame la requalification de son contrat en CDI.

Ce que conteste l’employeur : si le contrat de travail n’a pas été signé, c’est parce que le salarié a délibérément refusé de le faire, selon lui. Pour preuve : le salarié ne conteste pas qu’il a commencé à travailler, tout en sachant pertinemment qu’il s’agissait d’un CDD, dont il connaissait le terme.

Sauf que cela ne suffit pas à caractériser la mauvaise foi du salarié, ou son intention frauduleuse, souligne le juge. Or, il n’y a que sa mauvaise foi ou son intention frauduleuse, dûment établie, qui permettrait de faire obstacle à la requalification du CDD en CDI pour défaut de signature du contrat.

Et, ici, l’employeur n’apporte pas la preuve de cette mauvaise foi ou de cette intention frauduleuse du salarié…
