Le salarié d’une entreprise de travaux publics demande le versement d’une indemnité de grand déplacement, les moyens de transports en commun à proximité de son chantier ne lui permettant pas de rentrer chez lui chaque soir. Ce que l’employeur refuse, le salarié pouvant toujours avoir recours au covoiturage… A tort ou à raison ?


BTP : covoiturage ≠ transport en commun

Le salarié d’une entreprise de BTP demande le versement d’une indemnité de grand déplacement, le chantier sur lequel il travaille étant trop éloigné de son domicile pour lui permettre de regagner tous les soirs son domicile en transports en commun.

Il rappelle, en effet, qu’en vertu des conventions collectives nationales applicables pour les ouvriers des entreprises du BTP, cette situation s’apparente à un « grand déplacement » devant donner lieu au versement d’une indemnité pour le salarié contraint d’utiliser son propre véhicule plutôt que les transports en commun pour regagner son domicile chaque soir.

« Non », conteste l’employeur : le salarié n’a pas envisagé d’avoir recours au covoiturage, ce qui constitue pourtant, selon lui, un moyen de transport en commun que le salarié aurait pu utiliser pour regagner son domicile.

« Non », conteste à son tour le juge, qui précise que le covoiturage ne constitue pas un « transport en commun » au sens de la convention collective. Par conséquent, l’employeur devra bien verser au salarié une indemnité de grand déplacement.

Retenez que les conventions collectives dont il est ici question sont celles qui s’appliquaient à l’ensemble des entreprises du secteur jusqu’au 30 juin 2018. Toutefois, la notion d’indemnité de grand déplacement ayant été reprise en des termes identiques par les conventions collectives applicables depuis le 1er juillet 2018, la décision du juge semble toujours valable aujourd’hui.
