7 propriétaires d’une parcelle agricole louée par un exploit agricole (juridiquement, ils sont en « indivision ») lui délivrent un congé pour reprise au bénéfice du fils de l’un d’entre eux. Sauf que le congé va être annulé, faute d’avoir pris en considération une conséquence juridique de « l’indivision » : laquelle ?


Congé pour reprise et bail rural : « l’indivision » a d’importantes conséquences !

Un propriétaire signe un bail à long terme avec un exploitant agricole. Des années plus tard, à son décès, ses 7 enfants deviennent tous propriétaires en « indivision ». En justice, l’exploitant agricole est autorisé a cédé le bail à son fils, qui devient le nouvel exploitant agricole.

Plus tard, les 7 propriétaires donnent un congé pour reprise à l’exploitant agricole, au bénéfice du fils de l’un d’entre eux.

L’exploitant agricole va alors réclamer l’annulation de ce congé pour reprise et demander au juge de prononcer le renouvellement du bail.

Pour bénéficier du congé pour reprise, le fils d’un des héritiers devait respecter plusieurs conditions : l’une est d’obtenir une autorisation d’exploiter, ce que n’a pas ici obtenu le bénéficiaire de la reprise, constate l’exploitant agricole.

« C’est normal », répond celui-ci : il rappelle qu’il est possible de ne pas obtenir cette autorisation lorsque le bénéficiaire de la reprise démontre que le parent de qui il tient son droit de reprise détient les parcelles agricoles depuis au moins 9 ans. Ce qui est le cas ici, puisque son père est propriétaire des parcelles, avec ses frères et sœurs, depuis plus de 9 ans.

Sauf qu’il aurait fallu que son père détienne seul les parcelles agricoles pendant au moins 9 ans. Ce qui n’est pas le cas ici, puisque le père du bénéficiaire de la reprise en est propriétaire en « indivision » avec ses frères et sœurs, constate le juge.

Par conséquent, le bénéficiaire de la reprise aurait dû obtenir l’autorisation d’exploiter. Ne l’ayant pas, le congé pour reprise est nul et le bail est renouvelé.
