Quand les propos tenus par l’administration se retournent contre elle…

A l’issue d’un contrôle fiscal, l’administration réclame à une association sportive qui gère un club de tennis le paiement de la taxe d’habitation à raison des installations qu’elle exploite.

Elle rappelle, en effet, que la taxe est due pour les locaux meublés à usage privatif des associations à partir du moment où ils ne sont pas soumis à la cotisation foncière des entreprises (CFE), ce qui inclus, notamment, les locaux couverts où s’exercent des activités sportives, dès lors :

  • que des équipements mobiliers sont installés pour les rendre aptes à leur objet ;
  • qu’ils ne sont pas librement accessibles au public.

Sauf que l’administration a elle-même admis, à la suite d’une question posée au Gouvernement, que « les salles de compétition, vestiaires et locaux d’hygiène des groupements sportifs ne sont pas imposables » à la taxe d’habitation.

L’association n’est donc pas tenue, selon elle, au paiement de cette taxe.

Ce que confirme le juge, au moins pour les vestiaires et locaux d’hygiène : le sort des cours de tennis couverts sur lesquels l’association organise des compétitions sera, quant à lui, réglé ultérieurement.
