Un(e) assistant(e) maternel(le) peut décider de rompre un contrat s’il ou elle constate que l’enfant accueilli n’est pas vacciné. Et cette rupture à l’initiative de l’assistant(e) maternel(le) équivaut à une démission. La question qui se pose est de savoir si cette démission peut faire l’objet d’une indemnisation au titre de l’assurance chômage…F


Assistant(e) maternel(le) et démission légitime

Pour rappel, un(e) assistant(e) maternel(le) doit contrôler la réalisation des vaccinations obligatoires des enfants dont il ou elle assure la garde. Et il est conseillé à l’assistant(e) maternel(le) par le Ministère des Solidarités et de la santé, en cas de refus des parents de vacciner leur enfant, de refuser d’accueillir l’enfant si le contrat de travail n’a pas encore été signé ou de rompre le contrat de travail dans le cas d’un enfant déjà accueilli.

La question qui se pose, dans ce dernier cas, est de savoir s’il peut y avoir une indemnisation de l’assistant(e) maternel(le) par l’assurance chômage dans la mesure où la rupture du contrat est à son initiative, situation qui n’ouvre normalement pas de droit au chômage par Pôle Emploi.

Le Gouvernement vient de préciser, à ce sujet, que la réforme de l’assurance chômage a permis d’intégrer le refus de vaccination de l’enfant par ses parents parmi les motifs de démission légitime ouvrant droit aux allocations pour un(e) assistant(e) maternel(le).

Dans une telle situation, un(e) assistant(e) maternel(le) a donc droit à l’allocation d’aide au retour à l’emploi.
