A la suite d’une annulation de son vol, une passagère demande une indemnisation à la compagnie aérienne… Que cette dernière refuse de payer, estimant que la passagère n’apporte aucun élément permettant de prouver que son vol a bien été annulé… Qu’en pense le juge ?


Transport aérien : quid de l’indemnisation en cas d’annulation de vol ?

Pour mémoire, la règlementation européenne a mis en place un dispositif d’indemnisation des passagers lorsqu’ils subissent un refus d’embarquement de la part de la compagnie aérienne, un retard ou une annulation de leur vol.

Ainsi, lorsque toutes les conditions sont remplies, les passagers peuvent obtenir une indemnisation de :

  • 250 € lorsque le vol concerné est d’une distance égale ou inférieure à 1 500 km ;
  • 400 € pour tous les vols intracommunautaires de plus de 1 500 km et pour tous les autres vols d’une distance comprise entre 1 500 et 3 500 km ;
  • 600 € pour tous les autres vols.

Dans le cadre de cette règlementation, une passagère ayant subi une annulation de son vol décide de demander une indemnisation à la compagnie aérienne. Cette dernière refuse, estimant que la passagère n’apporte aucun élément permettant de prouver que son vol a été annulé.

« Peu importe ! », répond la passagère qui affirme qu’ici, c’est à la compagnie aérienne de démontrer qu’elle a bien assuré le vol concerné.

Ce que confirme le juge : lorsqu’un passager a bien reçu une confirmation de réservation de son vol, c’est au transporteur aérien de prouver que ce dernier a été effectué.
