Un bailleur rural délivre un congé à l’agriculteur en place, en lui indiquant qu’il s’agit d’un congé pour reprise au profit de son fils.

Ce que l’agriculteur conteste, indiquant :

  • que le fils du bailleur est responsable salarié de la maintenance au sein d’une entreprise et non pas ouvrier agricole, comme indiqué dans le congé ; il ne peut donc pas participer effectivement à l’exploitation des parcelles ;
  • que le fils mentionne qu’il envisage d’utiliser le matériel d’un agriculteur voisin pour exploiter les parcelles, sans pour autant expliquer comment il peut acheter les outils nécessaires à l’exploitation.

Parce que ces éléments ne lui permettent pas de s’assurer du sérieux du projet de reprise, le congé délivré par le bailleur n’est pas valide, selon l’agriculteur… et selon le juge.
