Un agriculteur arrête de verser les loyers dus à son bailleur après avoir quitté les lieux loués, état des lieux de sortie en main. A tort, selon le bailleur pour qui le loyer doit être versé jusqu’à la fin du préavis, qui se termine ici 15 mois plus tard. « Non » répond l’agriculteur, pour qui le bailleur a renoncé à ces loyers…

Un agriculteur donne son congé à son bailleur et lui notifie sa décision au moins 18 mois avant l’expiration du bail, comme la Loi l’y oblige.

Dans son courrier, l’agriculteur précise qu’il quittera les lieux loués non pas au terme du préavis, 18 mois plus tard, mais dans 3 mois.

Le bailleur lui répond par courrier qu’il prend acte du non-renouvellement du bail rural, et précise même dans ce courrier : « j’ai pris bonne note de votre départ pour cette date ».

A la date du départ convenu, un état des lieux de sortie est établi. Le locataire arrête alors de verser les loyers. Ce qui étonne le bailleur, puisque le bail rural prend fin dans 15 mois.

« Non », répond l’agriculteur : il rappelle que, dans son courrier, le bailleur avait pris bonne note de la date de son départ et qu’un état des lieux de sortie a été établi à la date convenue. Pour lui, le bailleur a donc renoncé au délai de préavis de 18 mois et aux loyers afférents.

« Non », conteste à son tour le bailleur : pour lui, les termes utilisés dans son courrier ne permettent pas d’en déduire une quelconque renonciation au préavis de 18 mois. Dès lors, l’agriculteur doit lui verser les loyers dus jusqu’à la fin du bail rural. Ce que confirme le juge.
