Agent immobilier : consultez les sites préfectoraux !

L’acquéreur ou le locataire d’un bien immobilier doit être informé par le vendeur ou le bailleur des risques et pollutions (naturels, miniers, technologiques, sismiques, radon, etc.) auxquels le bien immobilier est exposé.

Pour lui fournir cette information, il faut fournir un diagnostic appelé « état des risques et pollutions » (ERP). En pratique, les professionnels de l’immobilier se rendent sur le site web www.georisques.gouv.fr pour éditer ce diagnostic.

Ce qu’il ne faut pas faire, comme vient de le rappeler le Gouvernement : le contenu de ce site est purement informatif et n’a aucune valeur juridique.

Pour éditer un ERP valable, il faut, explique le Gouvernement, se rendre sur les sites web des Préfectures du lieu du bien immobilier mis en location ou vendu. Seuls les sites web des Préfectures comportent des informations qui font foi et sont opposables juridiquement.
