Depuis la Loi Alur, les professionnels de l’immobilier sont tenus d’une obligation de formation continue, dont le respect est vérifié par les CCI. Ce contrôle se limite-t-il aux seuls titulaires de la carte professionnelle d’agent immobilier ou vaut-il aussi pour leurs collaborateurs ? Réponse…


Agent immobilier : une formation continue contrôlée par la CCI !

A chaque renouvellement de carte professionnelle d’agent immobilier, la CCI vérifie que son titulaire a bien respecté son obligation de formation continue.

En pratique, la CCI limite son contrôle au seul titulaire de la carte d’agent immobilier. Or, celui-ci peut avoir des collaborateurs (salariés ou non-salariés) habilités à réaliser des opérations immobilières en son nom, qui sont eux-mêmes tenus de respecter une obligation de formation continue.

Un député a alors considéré que la CCI devait aussi contrôler le respect par ces collaborateurs habilités de leur obligation de formation continue.

« Non », a répondu le Gouvernement : la rédaction de la Loi Alur instituant l’obligation de formation continue ne crée par une procédure de vérification du respect de cette obligation pour les collaborateurs habilités du titulaire de la carte professionnelle.

C’est donc à ce dernier qu’il appartient de s’assurer de la compétence et du respect de l’obligation de formation continue de ses collaborateurs.
