Un agent immobilier propose à une mutuelle de louer un local dans lequel se trouvait auparavant un bar. Après la signature du contrat de cession du droit au bail, la mutuelle se rend compte que le plan local d’urbanisme (PLU) lui interdit d’exercer son activité dans le local. Une interdiction que l’agent immobilier aurait dû connaître, selon la mutuelle…


Agent immobilier : il ne faut pas négliger le PLU !

Un agent immobilier est chargé par une mutuelle de lui trouver des locaux dans lesquels elle pourra exercer son activité. L’agent immobilier va lui proposer de louer un local dans lequel est actuellement exploitée une activité de bar.

Le gérant du bar cède donc son droit au bail à la mutuelle, aux termes d’un acte notarié. Mais par la suite, la mutuelle ne peut pas exercer son activité dans le local loué en raison d’une interdiction résultant du plan local d’urbanisme (PLU).

La mutuelle réclame alors des indemnités à l’agent immobilier qui lui a proposé le local. Elle explique que ce dernier a commis une faute, en lui présentant un local situé dans un zonage urbain inadéquat.

Faute qui est sans lien avec l’impossibilité pour la mutuelle d’exercer son activité, répond l’agent immobilier : il rappelle qu’il a expressément renvoyé au notaire la responsabilité de rédiger les clauses et conditions nécessaires à l’accomplissement de la cession du droit au bail. Le notaire est donc le seul fautif.

Mais le juge condamne l’agent immobilier : parce que le droit au bail acquis par la mutuelle et proposé par l’agent immobilier est inutilisable et que le prix de cession a été payé en pure perte, il existe bien un lien entre le préjudice de la mutuelle et la faute de l’agent immobilier.

La responsabilité de l’agent immobilier est donc engagée et celui-ci doit indemniser la mutuelle.
