Un employeur embauche un salarié en contrat à durée déterminée (CDD) pour accroissement temporaire d’activité, qu’il renouvelle à de multiples reprises…

Si bien qu’un syndicat, représentatif dans l’entreprise, demande à agir à la place du salarié afin d’obtenir la requalification du CDD en contrat à durée indéterminée (CDI).

« Non », estime l’employeur : le syndicat est basé en Ile-de-France alors que l’établissement dans lequel le salarié est employé est situé à Montpellier… c’est-à-dire en dehors du périmètre géographique couvert par le syndicat !

Ce que confirme le juge : malgré le fait que le syndicat soit effectivement compétent pour agir en justice pour le salarié en matière de CDD, il ne peut pas représenter une personne située en dehors du périmètre géographique qu’il couvre.
