Sur une période de 2 ans, un particulier achète 3 appartements dans lesquels il réalise quelques travaux de rénovation avant de les revendre. Suffisant pour le qualifier de « marchand de biens », selon l’administration fiscale qui lui réclame un supplément d’impôt sur le revenu. Insuffisant pour le particulier, qui conteste cette qualification. Qui a raison ?


Marchand de biens : tout est question d’habitude !

Un particulier achète 3 appartements. Après quelques travaux de rénovation, il divise ces 3 appartements en 7 et les revend.

Des opérations d’achat-revente un peu trop fréquentes au goût de l’administration qui, à l’occasion d’un contrôle fiscal, qualifie le particulier de « marchand de biens » et lui réclame en conséquence un supplément d’impôt sur le revenu.

Ce que conteste le particulier qui ne voit pas ce qu’on lui reproche : en procédant à ces opérations, il tente simplement de faire fructifier son patrimoine immobilier.

Mais pas pour le juge qui partage l’avis de l’administration, rappelant :

  • qu’en moins de 2 ans, le particulier a acheté 3 appartements qu’il a divisés et revendus en 7 lots ;
  • que les appartements ont été vendus dans un délai de 3 à 18 mois après leur achat.

Autant d’éléments qui démontrent que le particulier se livre habituellement à des opérations d’achat-revente d’appartements, ce qui suffit à le qualifier de « marchand de biens ».

Le redressement fiscal est donc maintenu.
