Licenciement suite à un accident du travail : possible, sous conditions !

A la suite de difficultés économiques, une entreprise licencie un salarié qui occupe des fonctions de responsable d’exploitation. Sauf qu’il est en arrêt de travail consécutif à un accident de travail, lui rappelle-t-il, ce qui lui confère une certaine protection.

Certes, répond l’employeur, mais compte tenu de la subite dégradation de la situation économique de l’entreprise, avec notamment pour conséquence un résultat net en baisse de près de 13 %, et des mauvaises prévisions laissant présumer une nouvelle baisse de 59 % l’année suivante, l’entreprise n’a pas d’autre choix que de se réorganiser, en vue de préserver sa compétitivité.

Et parce que le salarié remplit les critères d’ordre des licenciements qui ont été fixés, il a prononcé son licenciement économique de manière tout à fait régulière, selon lui.

Sauf que le licenciement d’un salarié en arrêt de travail à la suite d’un accident de travail n’est possible que dans 2 cas, précise le juge :

  • en cas de faute grave du salarié ;
  • en cas d’impossibilité de maintenir le contrat de travail pour un motif étranger à l’accident.

Or, ni l’existence d’une cause économique de licenciement, ni l’application des critères de l’ordre des licenciements ne suffisent à caractériser l’impossibilité de maintenir le contrat. Le licenciement est donc nul et l’employeur doit indemniser le salarié.
