Une entreprise conclut, avec ses représentants du personnel, un accord instituant un plan d’épargne entreprise (PEE) et prévoyant un abondement de l’entreprise :

  • de 100 % des versements volontaires effectués par les salariés cadres ;
  • de 4 % des versements volontaires des salariés non-cadres.

Cependant, un syndicat et plusieurs salariés non-cadres contestent cet accord au motif qu’il contreviendrait au principe d’égalité de traitement. Ils réclament donc une indemnisation.

Sauf que peu de temps auparavant, les représentants du personnel et l’employeur ont conclu un accord relatif à l’aménagement et à la réduction du temps de travail, créant une situation défavorable pour les cadres en matière de durée du travail, rappelle l’employeur.

En guise de contrepartie, les parties à l’accord ont donc envisagé une amélioration du PEE des cadres, ce qui a conduit à négocier l’accord litigieux, remarque l’employeur.

Selon lui, cette inégalité salariale est donc justifiée et ne mérite pas d’annuler l’accord ou d’indemniser les salariés non-cadres.

Ce que confirme le juge qui déclare que la différence de traitement relative à l’abondement de l’employeur au versement volontaire des salariés est, en effet, justifiée par des éléments objectifs et pertinents, caractérisés par l’amélioration du plan d’épargne entreprise en contrepartie de mesures moins favorables pour les salariés cadres en matière de durée du travail.
