Le salarié nouvellement parent peut, s’il a au moins un an d’ancienneté dans l’entreprise, bénéficier d’un congé parental à temps partiel. Mais, au cas où l’entreprise serait contrainte de licencier ce salarié, comment calculer son indemnité de licenciement ?


Une indemnité de licenciement proportionnelle au temps de travail ?

Par principe, le salarié licencié qui a occupé alternativement un poste à temps complet et à temps partiel dans la même entreprise percevra une indemnité de licenciement tenant compte de cette alternance.

Par exemple, un salarié qui a 8 ans d’ancienneté, qui a travaillé 6 ans à temps plein et 2 ans à mi-temps percevra une indemnité calculée aux ¾ sur la base d’un temps complet et à ¼ sur la base de son mi-temps.

Mais cette règle s’applique-t-elle en cas de congé parental d’éducation à temps partiel ?

Le juge européen vient de répondre par la négative : cette méthode de calcul entraînerait une discrimination liée au sexe dans la mesure où, en France, 96 % des congés parentaux d’éducation sont pris par des femmes. Celles-ci seraient donc défavorisées par rapport à leurs collègues masculins, qui percevraient, quant à eux (et en l’absence de congé parental d’éducation à temps partiel), une indemnité de licenciement basée sur la rémunération perçue à temps plein uniquement.

Par conséquent, l’indemnité de licenciement d’un salarié en congé parental à temps partiel doit être calculée sur la base de la rémunération d’un temps plein.
