La réduction d’impôt Madelin incompatible avec les activités financières

Si vous souscrivez au capital d’une société, vous pourrez bénéficier d’une réduction d’impôt sur le revenu pour autant, notamment, qu’il s’agisse d’une PME exerçant une activité commerciale, industrielle, artisanale, libérale ou agricole.

Et sont expressément exclues les activités procurant des revenus garantis en raison de l’existence d’un tarif réglementé de rachat de la production, des activités financières, des activités de gestion de patrimoine mobilier.

Cela signifie-t-il que l’activité de courtier en assurance, qui consiste en la distribution de contrats d’assurance, est exclue de cet avantage fiscal ? Oui, selon l’administration pour qui il s’agit d’une activité financière.

Mais ce n’est pas aussi simple que cela : cette activité consiste en réalité à présenter, proposer ou aider à conclure des contrats d’assurance ou à réaliser d’autres travaux préparatoires à leur conclusion, ou à contribuer à leur gestion et à leur exécution, notamment en cas de sinistre.

Mais il s’agit aussi d’une activité qui consiste à mettre en relation d’affaires une personne cherchant à acquérir une prestation d’assurance et un assureur en vue de la conclusion d’un contrat d’assurance. En fournissant cette prestation, le courtier en assurance n’agit ni au nom, ni pour le compte d’une compagnie d’assurance, mais au seul bénéfice de son client, auquel il fournit une prestation d’entremise.

Il s’agit donc d’une activité commerciale, admise au bénéfice de la réduction d’impôt Madelin. C’est du moins ce que vient de rappeler et confirmer le juge de l’impôt.
