A la suite d’agissements fautifs d’une salariée, un employeur lui propose de modifier son contrat de travail, et de passer d’un temps complet à un temps partiel. Modification qu’elle accepte en signant un avenant à son contrat de travail. Mais l’employeur semble avoir omis un détail…


Procédure disciplinaire : attention à la notification de la sanction !

Un employeur convoque une salariée à un entretien préalable à une sanction disciplinaire. La semaine suivante, il lui propose de modifier son contrat de travail : un changement de poste et de durée hebdomadaire de travail. Concrètement, il s’agit d’une rétrogradation.

La salariée accepte et signe l’avenant à son contrat de travail. Mais elle va finalement contester cette sanction et demander au juge son annulation : elle estime que son employeur aurait dû lui notifier sa sanction. Ce qu’il n’a pas fait. Ce qui ne justifie pas l’annulation de l’avenant à son contrat de travail, quant à lui régulièrement conclu, rétorque l’employeur.

Mais parce que cette rétrogradation a été proposée après l’entretien préalable à une sanction disciplinaire, elle a effectivement un caractère disciplinaire, souligne le juge. Cette sanction aurait donc dû faire l’objet d’une notification écrite et motivée de l’employeur. En outre, l’employeur ne justifie pas avoir informé la salariée de sa faculté d’accepter ou de refuser une telle sanction.

Cette sanction doit donc être annulée et l’employeur doit payer à la salariée des rappels de salaires et de congés payés sur la base de son contrat initial (à temps complet).
