Quel statut pour le conjoint du dirigeant ?

Le chef d’une entreprise artisanale, commerciale, libérale ou agricole doit procéder à une déclaration lorsque son conjoint exerce une activité régulière dans l’entreprise et choisir le statut « collaborateur », « associé » ou « salarié ».

A défaut de déclaration ou en cas d’oubli de déclaration, le conjoint est réputé exercer sous le statut de conjoint salarié.

Des précisions sont toutefois attendues par Décret.

Enfin, en ce qui concerne les sociétés, le statut du conjoint collaborateur n’est autorisé qu’au conjoint du gérant associé unique ou du gérant associé majoritaire d’une SARL ou d’une SELARL, répondant jusqu’alors, à des conditions de seuils d’effectif fixées par Décret. Cette condition d’effectif sera supprimée à compter du 1er janvier 2020.
