En raison d’un manquement à son obligation de vigilance, une entreprise (donneur d’ordre) se voit réclamer, par l’administration fiscale, le paiement des impositions et pénalités dues par un cocontractant mis en cause pour travail dissimulé. A tort ou à raison ?


Sous-traitance : pas coupable, mais responsable…

Au titre de son obligation de vigilance, tout donneur d’ordre doit notamment s’assurer que son cocontractant s’acquitte de ses obligations sociales et fiscales. A défaut, il peut être solidairement tenu au paiement des cotisations, impositions et pénalités correspondantes, éventuellement dues par son cocontractant.

Et c’est justement un manquement à cette obligation de vigilance que reproche l’administration fiscale et le juge à une société, ici condamnée au paiement des impositions et pénalités (TVA, taxe d’apprentissage, etc.) dues par son cocontractant défaillant, au titre de la solidarité financière.
