La suspension du contrat de travail des soignants qui ne remplissent pas leur obligation vaccinale a suscité un vif débat, surtout dans les situations où les soignants étaient déjà en arrêt de travail au 15 septembre 2021. Un débat auquel le juge vient de mettre un terme. Explications…


Une suspension de traitement conditionnée

Pour rappel, s’ils ne remplissaient pas leur obligation vaccinale au 15 septembre 2021, les contrats de travail, ainsi que les rémunérations des soignants, étaient suspendus.

S’était alors posée la question du sort des soignants qui ne remplissaient pas cette obligation, mais qui étaient déjà en arrêt de travail au 15 septembre 2021… Une question qui avait donné lieu à des décisions contradictoires.

Finalement, le 2 mars 2022, le juge est venu trancher cette question en déclarant que la suspension de rémunération ne pouvait intervenir, dans ce cas précis, qu’à la date de fin du congé maladie.
