Dans le cadre d’un licenciement pour inaptitude, en l’absence de notification des motifs qui s’opposent à son reclassement dans l’entreprise, le salarié peut recevoir une indemnisation. Et si ce licenciement est requalifié en licenciement sans cause réelle et sérieuse, il peut aussi prétendre au versement d’une indemnité. Reste à savoir si ces 2 indemnités peuvent se cumuler…

Une question à laquelle le juge a répondu par la négative : ces 2 indemnités ne sont pas cumulables.
