Bail commercial et indemnité d’occupation : sous condition !

A la suite d’un litige avec son bailleur, le locataire d’un local commercial demande et obtient l’annulation (rétroactive) de son bail.

La raison ? Le local loué, qui était destiné à être exploité pour l’activité de « traiteur-restaurant-bar », s’est révélé impropre à sa destination en raison de l’absence d’un réseau d’évacuation des eaux usées.

« Qu’à cela ne tienne », rétorque le bailleur, qui prend acte de l’annulation rétroactive du bail et décide, à ce titre, de réclamer à son locataire le paiement d’une indemnité d’occupation pour le temps qu’il a passé dans les lieux…

« Une demande irrecevable », selon le locataire, qui rappelle qu’il n’a jamais pu profiter des lieux loués en raison de leur caractère inexploitable.

Ce que confirme le juge, qui rappelle que l’indemnité d’occupation représente la contrepartie de la jouissance des lieux. Ici, puisque le local était impropre à la destination prévue par le bail, le locataire n’a pas à régler d’indemnité d’occupation des lieux à la suite de l’annulation du bail.
