Elections professionnelles : vers un élargissement de l’électorat…

Pour mémoire, seuls les salariés des 2 sexes, âgés de 16 ans révolus, qui travaillent depuis au moins 3 mois dans l’entreprise et qui disposent de l’intégralité de leurs droits civiques peuvent être électeurs aux élections du comité social et économique (CSE).

Certains salariés, ne pouvant pas exercer un mandat de représentant du personnel en raison de leur statut de « salarié susceptible d’être assimilé à l’employeur », ne peuvent pas non plus être électeurs. Concrètement, cela concerne les salariés qui :

  • ont une délégation écrite leur permettant d’être assimilés au chef d’entreprise ;
  • représentent effectivement le chef d’entreprise devant les institutions représentatives du personnel.

Mais le fait que ces salariés soient évincés de l’électorat du CSE est-il légal ? Interrogé sur ce point, le juge vient de répondre par la négative. Pour lui, en effet, une telle exclusion constitue une atteinte manifestement disproportionnée au principe de participation des travailleurs, ces salariés ayant également le droit d’être représentés au CSE et donc, de participer aux élections.

Notez toutefois que si cette disposition est abrogée, elle ne le sera qu’à compter du 31 octobre 2022.
