Afin de rendre la prévention de la santé au travail plus efficiente, le gouvernement a pris de nombreuses mesures. Focus sur les projets de transition professionnelle et l’élargissement de la suppression des conditions d’ancienneté…


De nouvelles exceptions pour mieux tenir compte de l’état de santé du salarié

Pour rappel, le projet de transition professionnelle permet à tout salarié de mobiliser son compte personnel de formation (CPF) pour financer une action de formation certifiante, dans le but de changer de métier ou de profession.

Pour pouvoir en bénéficier le salarié doit justifier d’une ancienneté minimale.

Jusqu’à maintenant, échappaient à ces conditions d’ancienneté :

  • les salariés présentant un handicap ;
  • les salariés ayant changé d’emploi à la suite d’un licenciement économique ou pour inaptitude, à partir du moment où ils n’avaient pas suivi de formation entre le licenciement et leur nouvel emploi.

A compter du 31 mars 2022, cette suppression des conditions d’ancienneté concernera également les salariés ayant connu dans les 24 derniers mois avant la demande :

  • une absence en raison d’une maladie professionnelle ;
  • un arrêt de travail de longue durée.

Notez que la durée, selon laquelle un arrêt de travail peut être qualifié de « longue durée » doit être définie par un prochain décret (non encore paru à ce jour).
