Parce qu’il constate une dégradation du local commercial au départ de son locataire, un bailleur décide de lui réclamer une indemnisation. Mais est-il suffisamment « armé » pour le faire ?


Bail commercial : petit rappel sur l’état des lieux de sortie…

Une commune loue à un couple de commerçants un local commercial et un logement d’habitation.

A la suite de la libération des lieux, la commune demande aux anciens locataires le paiement de diverses dégradations locatives.

« A tort », selon ceux-ci, qui précisent que les dégradations en question dans le local commercial ont été constatées par le biais d’un procès-verbal d’huissier, dressé plus de 2 mois avant leur départ des lieux !

Ce qui invalide, selon eux, la demande d’indemnisation de la commune, puisque rien ne prouve l’existence des dégradations en question au moment de leur départ.

Mais leur argument ne convainc pas le juge, qui souligne que :

  • le constat d’huissier a été établi après que la commune a demandé, en vain, de visiter les lieux ;
  • les locataires n’apportent aucun élément prouvant que les constatations faites par l’huissier étaient erronées, pas plus qu’ils ne prouvent qu’ils auraient procédé à des travaux sur le local commercial avant leur départ.

La demande d’indemnisation de la commune est donc parfaitement fondée.
