Congé pour reprise : la seule possession d’un brevet professionnel est insuffisante

Un agriculteur reçoit un congé pour reprise de la part de son bailleur dont il conteste la validité. Motif invoqué ? Le bénéficiaire de la reprise ne remplit pas les critères d’aptitude professionnelle requis par la loi.

« Faux », conteste le bénéficiaire de la reprise : au jour de la délivrance du congé, il avait entamé des démarches pour obtenir un brevet professionnel de responsable d’entreprise agricole… qu’il a aujourd’hui validé. Il est donc apte à reprendre les terres louées et à les exploiter.

Sauf que la seule délivrance d’un brevet professionnel ne permet pas au bénéficiaire de la reprise de justifier qu’il remplit les critères légaux d’aptitude professionnelle, rappelle le juge. Le congé délivré à l’agriculteur est donc annulé.
