Une entreprise ayant placé, à titre exceptionnel, une salariée en 100 % télétravail, se voit finalement contrainte de la licencier, cette dernière refusant de réintégrer les locaux de l’entreprise en présentiel… Ce que conteste la salariée, qui estime qu’elle n’avait pas à revenir en présentiel… A tort ou à raison ?


Précisions quant à la mise en place du télétravail par avenant…

Une entreprise ayant placé, à titre exceptionnel, une salariée en 100 % télétravail à son retour de congé maternité, se voit finalement contrainte de la licencier, cette dernière refusant, malgré de nombreux rappels à l’ordre, de réintégrer les locaux de l’entreprise en présentiel.

« C’est normal », répond la salariée : le 100 % télétravail ayant donné lieu à la signature d’un avenant à son contrat de travail, le retour en présentiel représente une modification de son contrat pour laquelle l’employeur aurait dû obtenir son accord…

« Non », répond à son tour l’employeur, qui précise que l’avenant en question prévoyait que le 100 % télétravail était accordé à la salariée à titre exceptionnel… donc provisoire…

Mais, en l’absence de toute autre précision dans cet avenant, le placement de la salariée en 100 % télétravail doit être entendu comme étant exceptionnel non pas en raison de son caractère provisoire, mais parce qu’il était contraire aux pratiques habituelles de l’entreprise, estime le juge.

Et, parce qu’il était fixé par avenant, l’employeur ne pouvait effectivement pas ordonner le retour de la salariée en présentiel et donc modifier l’organisation de son travail, sans son accord.
