Une société exploitant une activité de service de réservation de taxis décide d’engager la responsabilité de l’un de ses concurrents.

Le motif ? Celui-ci propose des contrats d’abonnement aux taxis dans lesquels est prévue la fixation de pourboires systématiques et à l’avance.

Or, souligne la société, la règlementation sur les prix des taxis impose une tarification horokilométrique déterminée par le seul compteur du taxi… ce qui exclut tout pourboire éventuel !

Cette pratique, qui permet donc au concurrent de s’attirer une partie de la flotte des taxis parisiens qui se voit garantir le paiement d’un pourboire systématique constitue, selon la société, une faute déloyale… et indemnisable !

« Faux », rétorque le concurrent, pour qui la société ne peut obtenir d’indemnisation à défaut de prouver qu’elle avait une chance réelle et sérieuse de développer son activité, que la seule prévision de pourboire dans ses propres contrats d’abonnement a fait disparaître.

« Pas besoin », tranche le juge : le comportement déloyal du concurrent lui assurant un avantage concurrentiel indu au détriment des autres entreprises de taxis qui respectent la règlementation applicable cause nécessairement un préjudice à ceux-ci.

D’autant qu’ici, la société en question prouve bien avoir enregistré une baisse de chiffre d’affaires régulière depuis plusieurs années…

L’indemnisation réclamée est donc due.
