Une société d’intérêt collectif agricole (SICA) demande à bénéficier de l’exonération de taxe foncière réservée aux bâtiments affectés à un usage agricole. Sauf que les bâtiments appartenant à la SICA ne sont pas affectés à un usage agricole, estime l’administration, qui lui refuse alors le bénéfice de l’avantage fiscal. A raison ?


Exonération de taxe foncière : focus sur la notion « d’usage agricole »

Les bâtiments affectés à un usage agricole par les sociétés d’intérêt collectif agricole (SICA) sont exonérés de taxe foncière sur les propriétés bâties.

La notion « d’usage agricole » vise les opérations qui sont réalisées habituellement par les agriculteurs.

Or, les activités conduites par les SICA, soit pour le compte de membres n’ayant pas la qualité pour être associés coopérateurs d’une société coopérative agricole, soit pour le compte de tiers à la société dans un cadre commercial, ne sont pas des opérations « habituellement » réalisées par les agriculteurs.

Dès lors, les bâtiments affectés par les SICA à ce type d’activité ne peuvent pas bénéficier de l’exonération de taxe foncière.

Mais comme souvent en matière fiscale, il existe une exception à ce principe : l’exonération d’impôt sera maintenue si l’activité en question a pour seul objet de compenser une réduction temporaire des besoins des membres qui ont la qualité pour être associés coopérateurs d’une société coopérative agricole.

C’est précisément ce qui vient d’être rappelé à une SICA qui souhaitait bénéficier cette exonération de taxe foncière.

Dans cette affaire, une partie de l’activité de la société a été exercée pour le compte de membres n’ayant pas la qualité pour être associés coopérateurs d’une société coopérative agricole.

Et parce que la SICA n’a pas pu prouver que cette activité avait pour seul objet de compenser une réduction temporaire des besoins des membres qui ont la qualité pour être associés coopérateurs d’une société coopérative agricole, l’administration fiscale, puis le juge, lui ont refusé le bénéfice de l’exonération d’impôt.
