Une société, propriétaire d’un immeuble qu’elle loue à un établissement hospitalier, demande à être déchargée de la taxe d’enlèvement des ordures ménagères (TEOM), son locataire, soumis à une réglementation sanitaire particulière, assurant lui-même la collecte et l’élimination de ses déchets. A tort ou à raison ?

Une société, propriétaire d’un immeuble, le loue à un établissement hospitalier.

Au regard de la réglementation sanitaire qui lui est applicable, cet établissement assure lui-même la collecte et l’élimination de ses déchets.

Dès lors, parce que l’établissement ne bénéficie pas du service de collecte et de traitement des déchets ménagers assuré par la collectivité, la société demande à être déchargée du paiement de la taxe d’enlèvement des ordures ménagères (TEOM).

Pour mémoire, la taxe d’enlèvement des ordures ménagères (TEOM) est une taxe due tant par les particuliers que par les entreprises, dont le taux est fixé annuellement par les communes, et qui est destinée à financer la collecte et le traitement des déchets ménagers.

Cette taxe, qui n’a pas le caractère d’une redevance pour service rendu, est due par toute personne soumise au paiement de la taxe foncière sur les propriétés bâties, à raison d’un bien situé dans une commune où fonctionne le service, quand bien même elle ne l’utiliserait pas.

Et c’est précisément ce que l’administration, puis le juge, ont rappelé à la société, qui devra donc continuer à payer sa TEOM quand bien même son locataire ne profiterait pas du service public de collecte et d’élimination des déchets.
