Un marchand de biens a acheté un terrain bâti, et l’a revendu, après lotissement, en terrains à bâtir. Une opération de revente pour laquelle il demande à bénéficier du régime de la TVA sur marge… Ce que lui refuse l’administration fiscale. Pourquoi ?


De l’importance de distinguer les terrains bâtis des terrains à bâtir…

Un marchand de biens achète à un particulier un terrain sur lequel est implantée une maison. Parce que les particuliers ne sont pas assujettis à la TVA, la société n’a bénéficié d’aucun droit à déduction de TVA au moment de son achat.

Quelque temps plus tard, suite à la division de ce terrain, il revend 9 parcelles, dont 8 terrains à bâtir et, parce qu’il n’a pas pu récupérer la TVA au moment de l’achat du terrain, il soumet l’opération de revente à la TVA calculée sur la marge.

Ce que lui refuse l’administration fiscale, qui estime que la TVA doit être calculée sur le prix total de vente, et non pas sur la marge réalisée, car le bien revendu n’est pas juridiquement identique au bien acheté : le professionnel a acheté un terrain bâti et a revendu des terrains à bâtir.

Or, le régime de la TVA sur marge s’applique aux ventes de terrains à bâtir achetés en vue de leur revente, et non aux ventes de terrains à bâtir qui, lors de leur acquisition, avaient le caractère de terrain bâti.

Une position confirmée par le juge qui maintient le redressement fiscal.
