Une société qui a réalisé un diagnostic pour le compte d’une SCI réclame le paiement de sa prestation : 17 000 € HT. Mais la SCI refuse. Et comme aucun contrat n’a été conclu, la société va produire des attestations de tiers pour démontrer la réalité du contrat. Insuffisant, selon la SCI…


Litige supérieur à 1 500 € : il faut des preuves écrites… du cocontractant !

Une SCI possède des entrepôts qui ont été incendiés. Une société de travaux propose ses services pour déterminer la nature des désordres structurels qui affectent les entrepôts, moyennant une rémunération de 17 000 € HT. Cette proposition est acceptée par la SCI et la société de travaux réalise son diagnostic. Mais, par la suite, la SCI refuse de payer la société de travaux.

Pour prouver qu’elle doit obtenir le paiement de sa prestation, la société de travaux doit démontrer que la SCI a accepté ses services. Sauf que la SCI n’a pas signé la proposition écrite qui lui a été remise par la société de travaux.

La société de travaux va alors produire des attestations de la société d’assurance intervenue dans le cadre du sinistre, de la société d’expertise mandatée par l’assureur et de l’architecte auquel il a été fait appel pour la reconstruction des entrepôts. Pour la société de travaux, ces attestations constituent un faisceau d’indices qui démontrent qu’il y a eu un accord avec la SCI pour la réalisation de sa prestation.

Mais, pour le juge, ces attestations sont insuffisantes. Il constate que le prestataire réclame 17 000 € HT de rémunération. Or, au-delà d’un montant de 1 500 €, il est nécessaire pour la société de travaux d’apporter un écrit ou un commencement de preuve écrite émanant de la SCI. Ce qu’elle ne fait pas…
