A l’occasion d’un contrôle, l’administration rectifie le résultat fiscal d’une entreprise en imposant les bénéfices réalisés dans la catégorie des bénéfices industriels et commerciaux. Mais elle change d’avis, et décide finalement de les taxer dans une autre catégorie d’imposition. L’administration peut-elle changer la règle de droit qu’elle invoque en cours de contrôle ?


Contrôle fiscal : l’administration peut changer d’avis… sous condition !

Une entreprise fait l’objet d’un contrôle fiscal dans le cadre duquel l’administration décide d’imposer les bénéfices réalisés dans la catégorie des bénéfices industriels et commerciaux (BIC).

Quelque temps plus tard, elle modifie son approche, et décide finalement d’imposer ces mêmes bénéfices non pas dans la catégorie des BIC, mais dans celle des bénéfices non commerciaux (BNC).

Elle fait ce que l’on appelle, sur le plan juridique, une « substitution de base légale » : il s’agit d’une technique, strictement encadrée, permettant à l’administration de modifier le fondement légal d’un redressement à n’importe quel moment de la procédure.

Ce que conteste le dirigeant, pour qui cette substitution a conduit l’administration à le priver d’une garantie fondamentale qui consiste à pouvoir saisir la commission départementale des impôts directs et des taxes sur le chiffre d’affaires pour avis.

« C’est faux ! », répond le juge : eu égard à la nature du différend qui l’opposait à l’administration fiscale, l’entreprise pouvait tout à fait saisir cette commission… ce qui lui a d’ailleurs été rappelé par l’administration à l’occasion de leurs échanges.

L’entreprise ayant choisi de ne pas saisir la commission, alors même qu’elle pouvait le faire, la substitution de base légale opérée par l’administration fiscale est valable.
