Une société se voit refuser le bénéfice du crédit d’impôt en faveur de l’innovation pour les développements qu’elle a apporté à l’un de ses logiciels, l’administration considérant qu’il ne s’agit pas d’un « nouveau produit ». Pourquoi ?


Crédit d’impôt innovation : c’est quoi un « nouveau produit » ?

Une société, qui exerce une activité de programmation informatique, demande à bénéficier du crédit d’impôt en faveur de l’innovation, pour les nouveaux développements qu’elle a apporté à l’un de ses logiciels, mis sur le marché 2 ans plus tôt.

Refus de l’administration, qui rappelle que pour pouvoir bénéficier cet avantage fiscal, le nouveau produit développé doit remplir les 2 conditions suivantes :

  • il ne doit pas encore être mis à disposition sur le marché ;
  • il se distingue des produits existants ou précédents par des performances supérieures sur le plan technique, de l’écoconception, de l’ergonomie ou de ses fonctionnalités.

Ce qui n’est pas le cas ici. Elle constate, en effet, que si les développements réalisés par la société avaient bien pour objectif d’apporter des fonctionnalités supérieures au logiciel mis sur le marché 2 ans plus tôt, il n’est pas justifié que ces nouvelles fonctionnalités se distingueraient, par des performances supérieures, des autres produits déjà présents sur le marché.

En conséquence, la société ne peut pas bénéficier du crédit d’impôt en faveur de l’innovation, ce que confirme le juge.
