2 exploitants agricoles reçoivent un congé pour reprise de leur bailleur, un groupement foncier agricole, qui souhaite reprendre les terres qu’ils louent pour son propre compte et permettre à l’in de ses membres de les exploiter. Sauf que ses statuts ne le lui permettent pas, répondent les exploitants agricoles qui refusent de lui laisser les terres agricoles…


Groupement foncier agricole : un congé pour reprise valable… à quelles conditions ?

Un groupement foncier agricole (GFA) possède des terres qu’il loue à des exploitants agricoles. Il délivre un congé pour reprise à 2 exploitants agricoles, en respectant un préavis de départ de 18 mois. Dans ces congés pour reprise, un des membres du GFA est désigné comme étant le futur exploitant des parcelles.

Mais les exploitants agricoles vont contester la validité des congés pour reprise : ils constatent que, lorsqu’ils ont reçu les congés pour reprise, le GFA n’avait pas le droit d’exploiter directement des biens agricoles, puisque ses statuts ne le prévoient pas.

En conséquence, le membre du GFA mentionné dans les congés pour reprise comme « exploitant » ne peut pas avoir ce statut. Dès lors, les congés pour reprise sont nuls, estiment les exploitants agricoles.

Sauf que 7 mois avant la date d’effet des congés pour reprise, le GFA a modifié ses statuts pour ajouter à son objet social l’exploitation directe de biens agricoles. Et suite à cette modification, le GFA a désigné le membre mentionné comme futur exploitant dans le courrier comme ayant cette qualité. Les congés pour reprise sont donc valables, selon le GFA.

« Exact », confirme le juge.
