Majoration de taxe d’habitation : qui occupe le logement ?

Les communes peuvent décider, toutes conditions par ailleurs remplies, d’instaurer une majoration de la taxe d’habitation sur les résidences secondaires, dont le pourcentage peut être compris entre 5 % et 60 %.

Certains logements échappent toutefois à cette majoration : tel est le cas des locaux meublés conformément à leur destination, occupés à titre privatif par les sociétés, associations et organismes privés et non retenus pour l’établissement de la cotisation foncière.

Une exception qui conduit à exonérer totalement de majoration les sociétés civiles immobilières (SCI) ?

Pas pour le Gouvernement, qui rappelle que cette majoration est applicable aux seuls logements affectés à l’habitation et utilisés à des fins personnelles ou familiales, et que la qualité des propriétaires (particulier, société, etc.) est sans incidence.

En clair, une SCI pourra être tenue au paiement d’une taxe d’habitation majorée dès lors que le logement meublé à usage d’habitation dont elle est propriétaire n’est :

  • ni occupé à titre privatif par une société, une association ou un organisme privé ;
  • ni affecté à l’habitation principale de ses occupants.
