De nombreux terrains sont aujourd’hui laissés à l’abandon : dans une telle situation, le maire peut-il faire procéder d’office à un débroussaillement ? Si oui, peut-il imposer aux propriétaires de le payer ? Réponses…


Débroussaillage d’un terrain : rappel de la réglementation

Par principe, tout propriétaire privé d’un terrain est responsable de son entretien.

En cas de désordres ou de dangers générés par l’absence d’entretien d’un terrain, le maire peut-il faire procéder d’office à des travaux de débroussaillage ?

C’est tout à fait possible, la réglementation envisage d’ailleurs cette situation à plusieurs reprises !

Tout d’abord, il est prévu qu’à défaut d’entretien d’un terrain non bâti situé à l’intérieur d’une zone d’habitation ou à une distance maximum de 50 mètres des habitations, dépendances, chantiers, ateliers ou usines, le maire peut, pour des motifs d’environnement et après mise en demeure restée infructueuse, prendre un arrêté pour obliger le propriétaire à exécuter les travaux de remise en état de ce terrain.

Si malgré cet arrêté, le propriétaire refuse de s’exécuter, le maire peut faire procéder d’office au débroussaillage, aux frais du propriétaire.

Ensuite, les communes ont la possibilité d’effectuer ou de faire effectuer, à la demande des propriétaires, les actions de débroussaillement et de maintien en état débroussaillé des terrains, et de se faire rembourser les frais engagés par les propriétaires normalement tenus à ces obligations.

Enfin, pour les territoires réputés particulièrement exposés au risque d’incendie, la réglementation prévoit que la commune peut faire exécuter d’office des travaux de débroussaillement après mise en demeure infructueuse du propriétaire. Ces travaux sont effectués à la charge de celui-ci.
