Une clause générale anti-abus applicable en matière d’impôt sur les sociétés a été mise en place pour être applicable depuis le 1er janvier 2019 : dans quels cas et quelle incidence pour quelle conséquence ?


Anti-abus : une mesure spécifique à l’impôt sur les sociétés

Depuis le 1er janvier 2019, l’administrations peut rectifier un résultat imposable à l’impôt sur les sociétés en appliquant la « clause anti-abus générale ».

Concrètement, uniquement en matière d’impôt sur les sociétés, l’administration pourra appliquer cette mesure à chaque fois qu’une société aura obtenu un avantage fiscal dans des conditions allant à l’encontre de son objet ou de sa finalité.

Plus exactement, cette procédure peut s’appliquer lorsque les 2 conditions suivantes sont réunies :

  • un montage est mis en place en vue d’obtenir indûment un avantage fiscal (allant à l’encontre de l’objet ou de la finalité du droit fiscal applicable) ;
  • le montage n’a pas de justification économique (on dit alors qu’il n’est pas considéré comme authentique).
