Un employeur licencie un salarié pour faute grave. Sauf que ce dernier l’a informé, un mois auparavant, qu’il souhaitait être désigné représentant syndical au CSE. Information qui lui confère le statut protecteur des représentants du personnel, d’après le salarié. Mais d’après le juge ?


Information d’une candidature imminente = statut protecteur

Une entreprise licencie un salarié pour faute grave. Décision que ce dernier conteste, estimant qu’il bénéficiait du statut protecteur des représentants du personnel. Selon lui, l’employeur aurait donc dû obtenir l’autorisation de l’inspecteur du travail avant de prononcer son licenciement.

Il rappelle, en effet, qu’il a informé son employeur qu’il envisageait d’être désigné représentant syndical au comité d’établissement (maintenant CSE) à l’issue des prochaines élections professionnelles, lesquelles devaient se dérouler 15 jours après lui avoir communiqué cette information.

Et il a précisément reçu sa convocation le jour du 1er tour du scrutin. De quoi invalider le licenciement, selon lui.

Sauf que, pour bénéficier du statut protecteur, l’employeur devait avoir connaissance de l’imminence de sa candidature avant de le convoquer à l’entretien préalable, souligne l’employeur.

Or, lorsqu’il a convoqué le salarié à cet entretien, la candidature du salarié aux fonctions de représentant syndical au CE était non pas imminente, mais hypothétique puisqu’elle dépendait :

  • du déroulement et des résultats des élections professionnelles,
  • du choix réalisé par le syndicat concerné.

Mais le juge n’est pas de cet avis et donne raison au salarié : l’employeur ayant connaissance de l’imminence de sa candidature, il aurait donc dû solliciter l’autorisation de l’inspecteur du travail.
