Une banque a consenti à une société un prêt pour lequel 4 personnes se sont portées cautions. Cette société ayant été mise en redressement puis liquidation judiciaires, la banque a assigné en paiement les cautions.

Mais il se trouve que l’une des actions a été déchargée de son engagement jugé disproportionné. L’une des 3 autres personnes a alors réclamé à son tour l’annulation de son engagement de caution, soutenant qu’elle ne s’était rendue caution de la société qu’en raison de l’existence de trois autres cautions ; elle ne se serait jamais engagée si elle avait pu savoir que l’une d’entre elles ne disposait pas du crédit nécessaire pour assumer ses engagements.

Mais la banque rappelle qu’elle a donné son engagement de caution solidaire sans réserve ni condition.

Sauf qu’ici, l’engagement de caution des autres personnes doit être considéré comme déterminant pour son propre engagement rappelle le juge, qui donne donc raison à la caution…
