Suite à une rectification fiscale sur le montant de son impôt sur le revenu, un couple décide de réclamer une indemnisation à son conseiller en patrimoine, auquel il reproche un défaut de conseil. Mais la responsabilité du conseiller peut-elle être retenue dans cette situation ?


Un mauvais conseil ne signifie pas forcément une indemnisation

Sur les conseils de gestionnaire en patrimoine, un couple participe à un vaste programme de défiscalisation, et demande à bénéficier de l’avantage fiscal correspondant, ce que lui refuse l’administration à l’issue d’un contrôle fiscal.

Le couple se retourne alors contre son gestionnaire en patrimoine : parce que son mauvais conseil est à l’origine directe de la procédure de contrôle fiscal, il doit indemniser le couple à hauteur des suppléments d’impôts, intérêts de retard et majorations mis à sa charge.

Ce que conteste le gestionnaire en patrimoine : il rappelle qu’il n’est tenu de verser une telle indemnisation que dans le cas où le couple prouve qu’un conseil avisé lui aurait permis de ne pas régler cet impôt supplémentaire, ou de régler un impôt moindre. Ce qui n’est pas le cas ici !

Ce que confirme le juge : le couple soutient ici qu’un conseil avisé l’aurait fait renoncer à l’opération en cause, sans prouver en quoi celui-ci lui aurait permis de disposer d’une solution alternative lui permettant d’échapper au paiement de l’impôt supplémentaire mis à sa charge.

Par conséquent, sa demande d’indemnisation à l’encontre du cabinet de conseil est rejetée.
