Un transporteur voit l’un de ses camions détruit suite à l’auto-inflammation des déchets transportés. Il se retourne alors contre le client propriétaire des déchets, et décide de lui réclamer l’indemnisation pour son véhicule détruit… Mais le fait-il à temps ?


Véhicule endommagé par la marchandise : un an pour agir

Un transporteur prend en charge les déchets de l’un de ses clients en vue de leur acheminement.

En cours de route, et alors qu’il est stationné sur un parking, le camion utilisé pour le transport s’embrase, suite à l’auto-inflammation des déchets.

En vue d’obtenir une indemnisation, le transporteur décide alors de poursuivre son client pour être indemnisé de la destruction de son véhicule : il estime, en effet, que celui-ci reste responsable des déchets dont il est propriétaire, et qu’il a commis une faute en s’abstenant de lui signaler leur dangerosité.

« Sauf que la demande est trop tardive », répond le client : il rappelle que toute demande d’indemnisation relative à l’exécution d’un contrat de transport doit être faite dans l’année qui suit la date de livraison effective de la marchandise, ou celle prévue au contrat, si la marchandise est totalement détruite. Et puisqu’ici, la demande du transporteur intervient plus de 3 ans après cette date, elle doit être rejetée.

Ce que confirme le juge : pour être indemnisé des dommages causés à son propre véhicule par la marchandise transportée, le transporteur doit agir contre son client dans le délai d’un an prévu en matière de contrat de transport.

Parce qu’elle est ici trop tardive, la demande du transporteur doit être rejetée.
