Une entreprise recourt aux services d’un auto-entrepreneur pour son activité commerciale. Mais lorsque la prestation s’interrompt finalement, l’auto-entrepreneur réclame la requalification de son contrat en contrat de travail, afin d’obtenir les indemnités de rupture correspondantes. Avec succès ?


Contrat de travail = lien de subordination

Un auto-entrepreneur exerce une activité commerciale au profit d’une société. Mais cette dernière est finalement placée en liquidation judiciaire, mettant ainsi fin à la prestation.

L’auto-entrepreneur réclame alors la requalification de son contrat en contrat de travail, afin d’obtenir les indemnités de rupture correspondantes. A cette fin, il avance qu’il travaillait sous la subordination de l’entreprise, le lien de subordination caractérisant l’existence d’un contrat de travail.

Il devait, en effet, respecter un planning mentionnant des horaires de travail, travaillait dans un secteur attribué par l’entreprise qui lui assignait ses objectifs et devait respecter la procédure de vente qu’elle avait mis en place.

En outre, cet auto-entrepreneur apparaissait dans les listings de la société en qualité de commercial, participait à ses repas de fête et aux formations qu’elle proposait.

Mais pour le juge, cela ne suffit pas à caractériser le lien de subordination. Il constate effectivement qu’inscrit en qualité d’auto-entrepreneur, celui-ci gérait son emploi du temps (à l’exception de réunions et de visites ponctuelles), ne recevait aucun ordre ni directive précise et que ses objectifs ne faisaient l’objet d’aucun contrôle et d’aucune sanction.

Et parce que le lien de subordination n’est, ici, pas caractérisé, il n’y a pas de contrat de travail.
