Un couple se porte caution de deux prêts consentis par une banque à leur société. Suite à la mise en liquidation judiciaire de celle-ci, la banque se retourne contre le couple en lui rappelant son engagement… « disproportionné », selon celui-ci… A tort ou à raison ?


Caution : la fiche de renseignements peut être remise en cause

Un couple de dirigeants s’engage à rembourser les prêts consentis à leur société, si celle-ci n’est plus en mesure de le faire.

Ce qui finit par arriver : suite à la mise en liquidation judiciaire de la société, la banque se retourne contre le couple, en lui rappelant son engagement de caution.

« Sauf que celui-ci n’est pas valide » rétorque le couple, qui rappelle qu’au moment de s’engager, il était déjà tenu de rembourser 1 prêt personnel et 8 crédits à la consommation… et qu’un tel endettement rendait leur cautionnement disproportionné par rapport à leur situation financière. Par conséquent, ils ne peuvent pas être tenus au paiement des dettes de la société.

« Faux », répond la banque : elle précise qu’au moment de la signature de l’engagement de caution, elle avait demandé au couple de remplir une fiche de renseignements pour connaître son état d’endettement.

Or celle-ci ne mentionnait pas l’existence de ces 9 crédits ! A défaut d’en avoir été informée, la banque ne peut pas se voir reprocher d’avoir accepté un engagement qu’elle ne savait pas disproportionné.

Argument qui ne convainc pas le juge : parce qu’elle a elle-même accordé le prêt personnel du couple, et que les mensualités des crédits à la consommation étaient prélevées sur un compte détenu au sein de son propre établissement, la banque ne pouvait pas ignorer la situation d’endettement du couple.

Elle aurait donc dû refuser son engagement de caution… manifestement disproportionné… qui est donc annulé.
