Les fautes commises avant la liquidation judiciaire engagent la responsabilité du dirigeant

Une société est mise en redressement, puis en liquidation judiciaire.

Dans l’intervalle séparant les deux procédures collectives, le dirigeant commet plusieurs fautes de gestion… D’une importance telle, qu’elles le rendent responsable des dettes de la société estime le liquidateur.

Ce que conteste le dirigeant, qui considère que les fautes commises après l’ouverture d’une procédure collective ne peuvent pas lui être reprochées.

Ici, puisque la société était déjà en redressement judiciaire au moment où les fautes qui lui sont reprochées ont été commises, sa responsabilité financière ne peut pas être engagée…

« Faux », rétorque le juge, qui rappelle que seules les fautes commises après l’ouverture d’une « liquidation judiciaire », (et non d’une « procédure collective ») exonèrent le gérant de sa responsabilité financière.

Par conséquent, le dirigeant qui commet une faute de gestion après la mise en redressement judiciaire de sa société, mais avant l’ouverture de sa mise en liquidation judiciaire, peut être tenu pour responsable de ses dettes.

Le dirigeant doit donc rembourser les créanciers de la société !
